1. These terms
1.1 These terms govern your use of play4sats (the "Platform"), operated by Peritus Games ("we", "us", "our"). By creating an account or otherwise using the Platform, you accept them.
1.2 Before you enter your first paid match you must accept these terms and confirm that you are the age of 18 or older. You cannot pay to enter a match without doing so. You do this once; you are not asked again before each match.
1.3 If you do not accept these terms, do not use the Platform.
2. The service
2.1 The Platform hosts turn-based one-against-one skill games. Both players in a match receive an identical starting position generated from the same seed, play it independently, and the higher score determines the winner.
2.2 Our servers generate every deal, validate every move and determine every result. Your own device shows you a copy; it is never the authority. A result determined by our servers is final.
2.3 Hidden cards and values are held on our servers and released to your device only after the server has confirmed the move that legitimately reaches them.
2.4 Each match is subject to the time limit shown in the game. Your time limit starts at your first move, or — in a paid match — at the moment your payment is confirmed, whichever comes first. A match not completed within its time limit is scored as it stands when the limit expires.
2.5 A player who never plays a move is scored as if they had made none. Depending on the game that is either the lowest possible score or the starting position's score, and in some games that score can still win the match. This is deliberate.
3. Eligibility and accounts
3.1 You must have the legal capacity to enter into these terms in your country of residence.
3.2 You must be 18 or older to enter any paid match. Free play is open to anyone with the capacity in 3.1; if you are under 18 you may use the free Platform only with the consent of a parent or guardian.
3.3 Access requires a Google account. You may hold one account. Holding more than one is a breach of these terms.
3.4 You are responsible for all activity carried out under your account and for the security of the Google account used to access it.
3.5 Your display name is visible to other players and on leaderboards. It must not impersonate another person, infringe the rights of others, or be offensive. We may change or remove a display name that does not comply.
4. Where you may not play
4.1 You may not enter a paid match from Cuba, Iran, North Korea or Syria. We refuse stakes that appear to come from those countries, judged by the internet address your connection presents.
4.2 That check is approximate. It is your responsibility to know whether it is lawful for you to use the Platform where you are.
5. Paid matches
5.1 What a match costs.
The entry fee for a match is 55% of that match's prize. Half of the prize is funded by each player's entry fee; we keep the remainder, which is 10% of the prize across the two players. Both figures are shown to you before you pay.
5.2 Tiers.
Matches are offered at prizes of $1, $5, $10, $20 and $50, priced in bitcoin at the rate at the moment of payment. In each game only the $1 tier is available at first; higher tiers open as that game accumulates completed paid matches, and once open they stay open.
5.3 How you pay.
Each entry fee is a separate Lightning payment made from your own wallet. There is no account balance, no deposit and no withdrawal. We hold the amount between your payment and the settlement of the match, and pay the prize to the winner when the match is decided.
5.4 Where a prize is paid.
To the Lightning address recorded on your account at the moment you paid your entry fee — not to a later change. One Lightning address may be used by one account.
5.5 Winnings are yours to declare.
We do not withhold tax and we do not report on your behalf. What you owe, where you live, is between you and your tax authority.
6. When money is or is not returned
6.1 If you lose, your entry fee is not returned.
There is no partial refund.
6.2 If the match is drawn
Both entry fees are returned in full and we keep nothing.
6.3 If no opponent is found.
Your entry fee is returned when the match expires.
6.4 If the winner's Lightning address cannot receive the prize.
The result of the match still stands: the loser's entry fee is not returned. We hold the prize and retry payment for 72 hours. If it is still undeliverable after that, the prize is forfeited. We do not refuse a working address because the network failed to route to it.
6.5 A failure on your own device.
If the app loses a move or your connection drops, we repair your position forward and never roll it back — but we do not compensate for what a device or a network did. We cannot verify what happened on your side, and any rule that tried would be one someone could exploit.
7. Your right of withdrawal
7.1 Entering a match is a service we perform immediately: the moment your payment is confirmed, your seat is committed, your deal exists and your clock starts.
7.2 By accepting these terms under clause 1.2 you expressly ask us to begin performing as soon as you pay for a match, and you acknowledge that you lose your right of withdrawal for that match once we have. That acknowledgement is given once, with these terms, and is not asked again at each match. After the point of payment the entry fee is subject to clause 6 and nothing else.
7.3 Nothing in this clause affects your rights where we have failed to provide the service at all.
8. Fair play
8.1 You must not:
(a) use a bot, script, solver or other software to play on your behalf, or to select or evaluate moves for you;
(b) hold or use more than one account, or play against an account you also control;
(c) arrange a result with your opponent, or lose deliberately to move money between accounts;
(d) interfere with the Platform, its servers or another player's use of it;
(e) exploit a fault instead of reporting it to support@peritusgames.com.
8.2 Every paid match is verified before it pays.
We re-play the whole match against the deal we committed before it started and check that the record is intact. If a match does not verify we do not pay a prize on it, and we return both entry fees to the players who paid them.
8.3 We fix faults rather than police them. Where we find a way to gain an unfair advantage, our response is to close it.
9. Availability
9.1 We do not promise that the Platform is available without interruption. We may take it down for maintenance, and we may change or withdraw a game.
9.2 Where an interruption prevents a paid match from being decided, clause 6 governs what happens to the entry fees.
10. Suspension and termination
10.1 You may stop using the Platform at any time, and you may ask us to close your account at support@peritusgames.com.
10.2 We may suspend or close an account that breaches these terms. A paid match already under way is decided and settled normally; suspension does not take an entry fee that has been paid.
11. Intellectual property
11.1 The Platform, its games, their rules and their presentation are ours or our licensors'. You get permission to play, not to copy, adapt, decompile or redistribute.
11.2 The display name you choose remains yours to change; nothing else on the Platform becomes yours by playing.
12. Liability
12.1 We provide the Platform as it is. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded under Swedish law.
12.2 Otherwise, and to the extent Swedish law allows, our total liability to you in connection with any match is limited to the entry fee you paid for that match.
12.3 We are not liable for the Lightning network, for your wallet, or for a third party's service failing.
13. Changes to these terms
13.1 We may change these terms. The current version is always on this page, with its date, and takes effect when it is published.
13.2 A change does not alter the terms of a paid match you have already entered.
13.3 No waiver. If we choose not to enforce a term against you on one occasion, that does not mean we give up our right to enforce it later — whether against the same breach or a different one.
13.4 These terms, together with our Privacy Policy and our Responsible Play page, are the entire agreement between you and us about your use of the Platform. They replace anything else we may have said or written to you before you accepted them.
14. Law, complaints and disputes
14.1 These terms are governed by Swedish law, and the courts of Sweden have jurisdiction.
14.2 Write to support@peritusgames.com first — most things are settled there.
14.3 If we cannot agree, you may refer the matter to Allmänna reklamationsnämnden (ARN), Box 174, 101 23 Stockholm, www.arn.se.
